They govern your use of the Art du Bien-Être website and any consultations, plans, educational materials, communications, or wellness support services offered by Art du Bien-Être (“Art du Bien-Être,” “we,” “us,” or “our”).

 

1. ACCEPTANCE OF THESE TERMS

By using this website, submitting a form, contacting us, booking a consultation, purchasing a plan, or participating in a service, you confirm that you have read, understood, and agreed to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the website or purchase a service.You must be at least 18 years old to purchase services or enter into an agreement with us.

 

2. VOLUNTARY PARTICIPATION

You contact and engage Art du Bien-Être voluntarily. You decide what information to share, whether to participate, and whether to act on any suggestion. You may stop participating at any time, subject to any payment, cancellation, or refund terms that apply to your purchase and any rights granted by law.

 

3. NATURE OF OUR SERVICES

Art du Bien-Être provides personalized wellness education, lifestyle support, organization, reflection, self-advocacy support, and practical guidance informed by more than two decades of experience.Unless a service is expressly provided by an appropriately licensed healthcare professional acting in that professional capacity, our services are not medical care. Sabrina Aird is not a physician and does not diagnose disease, prescribe medication, perform medical treatment, replace licensed healthcare providers, or provide emergency services.Information and suggestions offered by Sabrina reflect her experience, education, observations, and professional opinion. They are not a medical diagnosis, prescription, or guarantee of any result.

 

4. MEDICAL DISCLAIMER AND SCOPE OF SUPPORT

All information, guidance, analysis, and recommendations provided through Art du Bien-Être are for educational and informational purposes and are intended to help clients better understand factors that may influence their health and well-being.

Art du Bien-Être may provide educational analysis and interpretation of health, lifestyle, laboratory, or genetic information when such analysis is included in the service purchased by the client.

Services provided by Art du Bien-Être do not constitute medical diagnosis or treatment and are not a substitute for medical care from a qualified healthcare professional. 5. LICENSED PROFESSIONALS AND REFERRALS

When appropriate and available, we may offer to introduce you to a nurse, physician, or other licensed professional within our professional network. Any licensed professional is responsible for services they personally provide, subject to their own professional duties, licensing rules, terms, consent process, and clinical judgment.An introduction or referral does not guarantee availability, acceptance, diagnosis, treatment, or outcome. Art du Bien-Être is not responsible for the independent acts or omissions of third-party professionals.

 

6. CLIENT RESPONSIBILITIES

You agree to provide information that is accurate and complete to the best of your knowledge. You remain responsible for your decisions, actions, healthcare, and safety.You agree to tell us when a suggestion conflicts with medical advice, creates discomfort, or appears inappropriate for your circumstances. You are responsible for consulting your healthcare provider before making material changes involving medication, treatment, supplements, diet, exercise, or other health-related practices.

 

7. NO GUARANTEE OF RESULTS

Every person, body, diagnosis, treatment plan, and circumstance is different. Testimonials and individual experiences do not guarantee that another person will achieve the same or similar results.We do not guarantee healing, prevention, diagnosis, improvement, financial benefit, or any particular medical, emotional, or lifestyle outcome. Statements describing possible benefits are educational and must not be understood as promises.

 

8. WEBSITE AND COMMUNICATION ACCURACY

We may disclose information when you authorize us to do so; when needed to provide a service through an authorized contractor or professional; when required by law, court order, or lawful process; or when reasonably necessary to address an imminent risk of serious harm, suspected abuse, fraud, security threats, or protection of legal rights.Internet, email, messaging, and video platforms cannot be guaranteed completely secure. Please do not send information you are not comfortable transmitting electronically.We will not record a private consultation without notice and appropriate consent. If a consultation is recorded, the purpose, access, and handling of the recording will be explained before recording begins.

 

10. PRIVACY

By using the website or submitting information, you acknowledge that electronic services may involve Wix, payment processors, analytics services, communication platforms, and other necessary providers.Health-related details may be sensitive personal information. 11. PURCHASES, FEES, AND PAYMENT

Prices, plan features, duration, and included services are described on the website or during the purchasing process. Payment is due according to the terms shown at checkout. You authorize the applicable payment processor to charge the payment method you provide.You are responsible for reviewing the plan description before purchasing. Additional services outside the purchased plan require separate agreement and payment.

 

12. CANCELLATIONS, RESCHEDULING, AND REFUNDS

Please provide at least 24 hours’ notice when cancelling or rescheduling an appointment. A late cancellation or missed appointment may be treated as a used session when permitted by law and when the applicable plan or booking information disclosed this condition.Refund eligibility depends on the service purchased, work already performed, resources already delivered, and applicable law. We do not limit any mandatory consumer right.For consumers entitled to a statutory withdrawal period for an online service, including eligible consumers in the European Union, that legal right remains in effect. If you expressly request that a service begin during a withdrawal period, you may be responsible for the proportion of services already provided. If the service has been fully performed after your express request and legally valid acknowledgment, the right of withdrawal may end where permitted by law.

 

13. INTELLECTUAL PROPERTY

The website, written materials, questionnaires, frameworks, graphics, branding, downloads, and original educational content are owned by or licensed to Art du Bien-Être and are protected by applicable intellectual-property laws.You may use purchased or provided materials for your personal, non-commercial use. You may not copy, sell, publish, distribute, teach, sublicense, modify, or commercially exploit them without written permission.

 

14. ACCEPTABLE USE

You may not misuse the website, interfere with its operation, attempt unauthorized access, submit unlawful or harmful material, impersonate another person, scrape or copy protected content, or use our services to harass, threaten, defraud, or violate another person’s rights.

 

15. THIRD-PARTY SERVICES AND LINKS

Art du Bien-Être may reference, recommend, or provide links to independent third-party services, products, laboratories, testing providers, or other resources. These third parties operate independently of Art du Bien-Être, and clients are responsible for reviewing their terms, policies, services, and requirements.

Genetic testing is performed by independent third-party testing providers. Genetic testing laws and availability vary by country. Clients are responsible for determining whether genetic testing is permitted in their country or jurisdiction and for complying with all applicable local laws and regulations.

Art du Bien-Être does not provide or facilitate genetic testing in France. Article 16-10 of the French Civil Code restricts genetic testing in France to legally authorized medical or scientific research purposes and prohibits advertising solicitation concerning such testing.

Art du Bien-Être may analyze genetic information previously obtained by a client as part of its educational wellness services, subject to applicable law.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Art du Bien-Être and its owner, personnel, and contractors will not be liable for indirect, incidental, special, punitive, or consequential loss arising from use of the website or services, reliance on educational information, third-party services, technical interruptions, or decisions made without appropriate professional medical guidance.Where liability cannot be excluded, our aggregate liability arising from a paid service will be limited to the amount paid for the specific service giving rise to the claim, except where a higher remedy is required by mandatory law.

 

17. INDEMNITY

To the extent permitted by law, you agree to be responsible for losses or claims resulting from your unlawful misuse of the website, violation of these Terms, infringement of another person’s rights, or intentional misrepresentation of information. This provision does not make you responsible for Art du Bien-Être’s own unlawful conduct.

 

18. SUSPENSION OR TERMINATION

We may decline, suspend, or end services when participation is unsafe, abusive, unlawful, outside our scope, affected by nonpayment, or no longer appropriate. When reasonably possible, we will explain the decision and address any unused prepaid services in accordance with the purchase terms and applicable law.

 

19. GOVERNING LAW AND MANDATORY RIGHTS
For services provided entirely online, these Terms are governed by the laws of the State of Florida and applicable federal laws of the United States, without regard to conflict-of-law principles. Services provided in person in France may be governed by separate terms and by applicable French and European Union law.

Nothing in these Terms deprives a consumer of any mandatory rights or protections that cannot legally be waived under the laws applicable to that consumer. Before filing a non-urgent claim, please contact us so that both parties may attempt to resolve the concern in good faith.

 

20. CHANGES TO THESE TERMS

We may update these Terms when our services, technology, or legal obligations change. The revised version will be posted on this page with an updated effective date. Material changes will apply prospectively unless the law permits otherwise.

 

21. SEVERABILITY AND ENTIRE AGREEMENT

If any provision is found invalid or unenforceable, the remaining provisions will continue to apply. These Terms, the Privacy Policy, the applicable plan description, and any written service agreement form the agreement between you and Art du Bien-Être regarding the relevant service.
